Administrative Driver's License Suspension (ALS)

If you are arrested on suspicion of a DUI, either refusing the Intoxilyzer test or blowing over .08, your driver's license will be automatically suspended. However, you have the right to request a hearing within a specific period of time to have the BMV review your situation and potentially grant you a temporary license or minimize the suspension. The administrative suspension is usually between 15 and 30 days on a first DUI offense or refusal. For offenses beyond that, the number of days that the license is suspended increases. There is often a reinstatement fee that gets charged, but consult with your lawyer on whether or not to pay this or if it is applicable to you. In most cases, you want to leave the fee alone until your case is concluded, as you may end up paying this fee twice (once on an administrative suspension and once on a court-ordered suspension).

Driver's License Suspension at the End of a Case

Regardless of the status of your driver's license at the end of your DUI/OVI case, you may lose it if you are convicted. When the case is completed, and a conviction is returned or a guilty plea accepted, the court may terminate your temporary license and court-order the suspension of your license.
